China’s NME status at the WTO: analysis of the debate

Purpose Although officially ended in July 2020, China’s dispute about its non-market economy (NME) status at the World Trade Organization (WTO) is far from being resolved. The NME enables counterparts to disregard Chinese prices antidumping proceedings and instead use so-called surrogate country methodology. This paper aims structure analyze complex debate, which emerged with disputes China has filed against European Union USA WTO, therefore provide a point of reference for future analysis debates status. Design/methodology/approach based on existing academic literature topic legal WTO-related documents (e.g. multilateral agreements, Accession Protocol, findings WTO panels). Findings Four different interpretations respective are discussed strong weak aspects these pointed out. Also, several misunderstandings mistakes appearing debate clarified. Practical implications As question position not been resolved yet some authors believe that will pursue case again once Appellate Body revives functionality, can serve as research this topic.
